A new plea says Sports should be made a Fundamental Right

A PIL filed by Kanishk Pandey of a sports-based NGO has asked the Supreme Court to consider Sports as a Fundamental Right. Pandey works for an NGO called 'Sports: A way of life' and is being represented by advocates Siddharth Dave and Rajiv Kumar Dubey. The Fundamental Rights are a part of the Indian Constitution that talk about the fundamental obligations of a state to its citizens and vice-versa. In short, they are the basic rights which, of which, no citizen can be deprived. There are some basic fundamental rights, to that effect- Right to Equality, Right to Freedom, Right to Freedom of Religion, Cultural and Educational Rights, Right to Constitutional Remedies. Pertaining to that, Pandey has filed a PIL to make Sports a fundamental right under section 21A (Right to education). The petition argues that Sports and education go hand-in-hand and help a child be better prepared to cope with various challenges. “Their confidence and patience level will also be strong through sports activities and competition involved in sports,” the petition said. The petition has also asked the court to instruct the government to bring in a new set of laws, in order to better promote and organize sports. This has to be done by incorporating it into the Directives Principles and fundamental duties of the Constitution and make it a part of the school curriculum. The Supreme court has now given Centre four weeks to respond. The Bench has also issued a notice to the State governments, University Grants Commission, Union Human Resource Development Ministry, Sports and Youth Affairs Department, Ministry of Finance, and Sports Authority of India regarding the same.
